Absztrakt: A polgári és kereskedelmi ügyekben folytatott európai igazságügyi együttműködés keretében a tagállami bíróságoknak 1971 óta van lehetőségük ügyeikben az Európai Bírósághoz, majd a névváltoztatást követően az Európai Unió Bíróságához fordulni az egyes nemzetközi jogi dokumentumok, illetőleg a másodlagos jogforrások rendelkezéseinek értelmezése céljából. A tagállamok gyakran folyamodnak ehhez az eljáráshoz, és az Európai Unió Bírósága évente 20-25 európai polgári eljárásjogi ítéletet hoz, ezzel próbálva iránytűként szolgálni a jogalkalmazók számára az európai polgári eljárásjog bonyolultnak tűnő rendszerében. Jelen tanulmány az ötödik abban a sorozatban, amelynek az elmúlt évekhez hasonlóan az egyetlen célja az európai polgári eljárásjog forrásaival kapcsolatban 2021-ben hozott döntések bemutatása, ezzel is megkönnyítve a téma iránt érdeklődők munkáját.

Abstract: Under the European judicial cooperation in civil and commercial matters, the Member States have had the opportunity to refer cases to the European Court of Justice since 1971 and, following its name change, the Court of Justice of the European Union for the interpretation of certain provisions of conventions and secondary legislation. The Member States often resort to this procedure and the Court of Justice of the European Union delivers 20 to 25 judgments regarding European civil procedure law each year, trying to serve as a compass for law enforcement in the seemingly complicated system of European civil procedure law. The present study is the fifth in a series, its sole purpose is, as in previous years, to present decisions taken in 2021 in relation to sources of European civil procedure law, thereby facilitating the work of those interested in the topic.
